I don't know about best, keeping in mind every one has their own fighting technique, but as far as legal weapons go I would say the Kubaton (legal in some countries) looks like a ordinary keyfob is really just a piece of metal (http://en.wikipedia.org/wiki/Kubotan)
However your keys are going to do as much damage if not more. Another similar weapon would be a pen, not one of these poxy bics, get yourself a nice chunky pen, used similary to the kubaton; hardening your fist when u grip it, putting some bone breaking capability on your hammer fists, and the nib is great for maniplulation and drawing penis' on unconcious foe.

I doubt that is a legal weapon to carry in the majority of jurisdictions. Daggers and dirks are poor defensive weapons. The inability to deliver an effective slash leaves you with stabbing attacks which often go unnoticed in the heat of battle. It is cool looking an probably makes a great addition to a ninja kit but it's a poor defensive weapon.

its legal here in CA. we just cant carry autos or butterfly knives. double edge is fine if its not concealed.

I'm saying it's unlikely you're going to do enough damage to stop the attacker without killing them, neither of the scenarios you listed should require a trained martial artist to kill the attacker. Being covered in a crackheads blood over a headlock in a drive through and killing a school teacher in a Denny's parking lot both sound like the actions of a freaked out gear geek unable to think under stress. Perhaps you should stop letting crackheads in your car, without a brain weapons are a liability not an asset.
