Open Question: Can I get an exchange on my Xbox 360?

Ok so I got an Xbox 360 Elite from best buy about 2 months ago I have a warranty for it and I want a new one because the one I got keeps on freezing sometimes for instance when I'm finding a match on CoD:4 and press the dashboard button it will freeze for like 10 seconds but if I press the Guide button I can still hear it and sometimes it will unfreeze I want to know exactly what I need and if I will get a new one or a refurbished one.
